Unless otherwise agreed, quantities parked and/or loaned each day must
be removed and/or returned within day parked and/or loaned, and the
removal and/or return of park and/or loan quantities will occur at
the same Loc(s) as the initial park and/or loan.
K Holder will provide a schedule to Transporter prior to the submission
of a PALS service request by K Holder each Day showing the projected
hourly aggregate deliveries at the applicable Delivery Point, and if
Transporter so request the associated TSA(s) to be used for the
applicable gas Day or portion thereof. Subject to the availability
of capacity and actions taken under Section 20, GT&C, of Transporter's
Tariff, the net aggregate quantity loaned, returned, parked and/or
removed, as applicable, shall be based on such schedule of hourly
activity. K Holder will submit nominations representing aggregate
positive or negative quantities, and such nominations will be deemed
to authorize the park and removal activities or loan and return
activities necessary to accomplish the submitted schedule.
Following an initial park or loan position, subsequent activity
within a given Day under this Agreement that could be characterized
as either initial or follow-up (removal of park or return)
activity shall be deemed to be either a removal or parked (on a first-in,
first-out basis) or return of loaned (on a first-out, first-in basis)
quantities, as applicable, until the park or loan account inventory
balance reaches 0, prior to being deemed activity for subsequent park or
loan activity, as applicable.
If actual utilization is less than the aggregate nominated for the Day
(or part thereof), the specified Activity Rate(s) may be adjusted
upward (not to exceed maximum Activity Rate), to permit Transporter to
collect an amount equal to that which would have resulted from
application of the Specified Activity Rate(s) to the nominated aggregate
activity.
Quantities shown in IT Qty - Loc above for each eligible location
and term shall not exceed the daily quantities described in Terms/Notes.
The Rate Chgd herein apply only to the services described above,
including without limitation, the quantities, locations, and terms
stated above; all other services will be provided at maximum Tariff
rates, including any applicable Fuel Use, LUFG and surcharges.
The Max Trf Rate for Activity is $.2201 and Max Trf Rate for Inventory is
$.2201.
Contract reflects a Park and Loan transaction.
